The electronic police state

gerddie writes "Cryptohippie has published what may be called a first attempt to describe the 'electronic police state' (PDF). Based on information available from different organizations such as Electronic Privacy Information Center, Reporters Without Borders, and Freedom House, countries were rated on 17 criteria with regard to how close they are already to an electronic police state. The rankings are for 2008. Not too surprisingly, one finds China, North Korea, Belarus, and Russia at the top of the list. But the next slots are occupied by the UK (England and Wales), the US, Singapore, Israel, France, and Germany." This is a good start, but it would be good to see details of their methodology. They do provide the raw data (in XLS format), but no indication of the weightings they apply to the elements of "electronic police state" behavior they are scoring.

coondoggie writes "I suppose it's natural for Washington to try and wrap issues up in a tidy legislative package for bureaucratic purposes (or perhaps other things more nefarious). But one has to wonder if we really need another government-led group, especially when it comes to the climate and all the sometimes controversial information that entails. But that's what is under way. Today the House Science and Technology Committee's Subcommittee on Energy and Environment held a hearing on the need for a National Climate Service, that could meet the increased demand for climate information, the committee said. The NCS would provide a single point of contact of information climate forecasts and support for planning and management decisions by federal agencies; state, local, and tribal governments; and the private sector."

Mike writes "Law prof Eugene Volokh blogs about a US House of Representatives bill proposed by Rep. Linda T. Sanchez and 14 others that could make it a federal felony to use your blog, social media like MySpace and Facebook, or any other Web media 'to cause substantial emotional distress through "severe, repeated, and hostile" speech.' Rep. Sanchez and colleagues want to make it easier to prosecute any objectionable speech through a breathtakingly broad bill that would criminalize a wide range of speech protected by the First Amendment. The bill is called The Megan Meier Cyberbullying Prevention Act, and if passed into law (and if it survives constitutional challenge) it looks almost certain to be misused."

Bandwidth fines bad, but not net neutrality issue

Frequent Slashdot contributor Bennett Haselton writes with his take on the recent Time Warner Cable fiasco: "Net Neutrality crusaders at FreePress.net recently called attention to Time Warner's plan (later rescinded) to impose fines on users for going over bandwidth limits. I agree generally, but I think this is easily confused with the reasoning in favor of Net Neutrality, and it's important to keep the arguments separate." Read on for the rest of Bennett's thoughts.

Rapidshare divulges uploader information

Gorgonzolanoid notes a post on TorrentFreak reporting that the German Rapidshare is divulging uploader information to rights holders. Record labels are apparently making creative use of "paragraph 101" of German copyright law, which gives them a streamlined process to ask a court to order disclosure of information such as an IP address. "In Germany, the file-hosting service Rapidshare has handed over the personal details of alleged copyright infringers to several major record labels. The information is used to pursue legal action against the Rapidshare users and at least one alleged uploader saw his house raided."

At&t sends mixed message on behavioral advertising

Ian Lamont writes "An advertising company that runs a 'targeting marketplace' and partner AT&T are playing down the telecommunications giant's use of its services after AT&T's chief privacy officer told a House subcommittee yesterday that the company does not engage in behavioral advertising. The AT&T executive testified (PDF) to the House of Representatives Subcommittee on Communications, Technology and the Internet that AT&T would not use behavioral advertising methods without informed customer consent. However, AudienceScience, a company that records 'billions of behavioral events daily' has apparently worked for AT&T since 2005. After the hearing, AudienceScience removed a client testimonial relating to AT&T from its website, so 'all the appropriate parties [have] consistent messaging,' its CEO said. An AT&T spokesman also said that the testimony was talking about AT&T's role as an ISP, not an advertiser."

Couple's home mistakenly used for artillery practice

Kathy and Rich Nelson are still a little shell shocked after a stray 102-pound artillery shell narrowly missed their house and plowed a path through their woods. The shell fired from Camp Ripley, Minn., was one of eight inert wax-filled rounds fired during a test by BAE Systems. The shell streaked over the Nelson home, startling three remodelers, two of whom were outside sawing cabinetry materials. "I was upstairs and had the window open and I heard this loud ppsshh, like a giant bottle rocket being set off, and it wasn't three seconds and it was right over us," said Loren Patnode of Patnode Custom Cabinets.
