China blocks youtube, again

cryfreedomlove brings news that YouTube has once again been blocked in China. The Google-owned video site was censored in China last year because of videos about the protests in Tibet, and that may be the impetus behind this latest restriction. According to a New York Times report, "'The instant speculation is that YouTube is being blocked because the Tibetan government in exile released a particular video,' said Xiao Qiang, adjunct professor of journalism at the University of California, Berkeley... Mr. Xiao said that the blocking of YouTube fit with what appeared to be an effort by China to step up its censorship of the Internet in recent months. Mr. Xiao said he was not surprised that YouTube was a target. It also hosts videos about the Tiananmen Square protests and many other subjects that Chinese authorities find objectionable."

Max payne 3 announced for next winter

tordavis writes with news that Rockstar Games has announced Max Payne 3 is in the works for the PS3, Xbox 360, and PC. It's currently planned for this coming winter. Quoting the news release: "'We're starting a new chapter of Max's life with this game,' said Sam Houser, Founder of Rockstar Games. 'This is Max as we've never seen him before, a few years older, more world-weary and cynical than ever. We experience the downward spiral of his life after the events of Max Payne 2 and witness his last chance for salvation.' Ebay describes the scale of its counterfeit goods problem

Ian Lamont writes "As the Tiffany vs. eBay lawsuit winds its way through a federal appeals court, eBay has trotted out some numbers that show how many sellers attempt to sell fake goods on the auction site. Millions of auctions were delisted last year, and tens of thousands of accounts were suspended after reports were made to eBay's Verified Rights Owner program, which lets trademark owners notify eBay of fake goods being sold on the site. eBay says 100% of reported listings were removed from the site last year, most within 12 hours, and the company uses sellers' background information to make sure that they don't create new accounts to sell delisted items. Tiffany brought the suit against eBay in 2004, alleging that eBay was turning a blind eye to counterfeit luxury goods and demanding that eBay police its listings for bogus goods. Tiffany lost the case last July and will shortly present its arguments to the US Court of Appeals for the Second Circuit in New York. A similar case in France cost eBay $61 million."

Macworld is reporting that Apple and AT&T are being sued, again, for the lack of delivery on their 3G network. This follows a long line of other lawsuits in San Jose, San Diego, Alabama, Florida, Texas, and New York "The lawsuit charges the companies with Negligence, Breach of Express Warranty, Breach of Implied Warranty of Merchantability, Unjust Enrichment, Negligent Misrepresentation, Violation of the New Jersey Consumer Fraud Act and Other Similar State Statutes, and Breach of Contract. Dickerson is seeking to force Apple and AT&T to correct its labeling and advertising, as well as to recover compensatory, statutory and punitive damages."

Recovery.gov not very transparent

Bob the Super Hamste writes "CNN is reporting that the page recovery.gov is not as transparent as it claims to be. The examples pointed out are: 1. The user is greeted by a large pie chart that show the breakdown of money spent by 2 categories, state government distributions and local government distributions. 2. Finding projects involves a complicated search, information on projects is not actually hosted on recovery.gov 3. The format of the information available is of poor quality (the article specifically mentions a PDF document that was created from a scanned sideways copy of roadwork projects from New York state). Given that this site was meant to make the spending of the new stimulus money more transparent to the citizens of the Unites States of America it seems oddly opaque. CNN does seem to praise the ability for government agencies to be able to exchange HTML based information between systems, which for government I would call a massive accomplishment. I tried to find information for my state and searched for Minnesota. I got 4 matches, 2 of which were generic ones: one was the Minnesota state certification that is required for a state to receive funds and one that lays out public transportation spending for all states of which Minnesota gets $94,093,115."

From the article: '"You have your Internet persona, and you have what you actually do on the street," Officer Ettienne said on Tuesday. "What you say on the Internet is all bravado talk, like what you say in a locker room." Except that trash talk in locker rooms almost never winds up preserved on a digital server somewhere, available for subpoena.'"

The student, 'John Doe #3,' had filed an appeal and motion for stay pending appeal, arguing that the appeal 'raises significant issues, some of first impression' (PDF), such as the standards for the use of ex parte procedures for expedited discovery, the scope of the First Amendment right of anonymity over the internet, the scope of the distribution right in copyright law, and the pleading requirements for infringement of such right."

Byzantine writes "The Mississippi Legislature has passed MS House Bill 1461 which would amend the state's tax laws specifically to charge sales tax on 'electrically transferred digital products,' including products bought via mail-order. The bill is currently on the governor's desk awaiting signature." Softpedia claims that 20 states have enacted download taxes of one sort or another — most of them for iTunes music — and that New York is considering taxing downloads of all kinds.
